By accessing this website or contracting my services, you agree to be legally bound by these Terms, which establish a contractual relationship between you (“The Client”, “The User”) and Love Pura Vida LLC (“The Coach”, “We”, “Us”), operating under the laws of the State of Florida.
1. HEALTH DISCLAIMER AND SCOPE OF PRACTICE (IMPORTANT)
This is the most critical section of this agreement. By working with me, you acknowledge and agree to the following:
• Not Medical or Psychological Practice in the US: Mari OM acts exclusively as a Certified Health Coach. Although I hold a bachelor’s degree in Psychology obtained in Costa Rica, I am NOT a psychologist, psychiatrist, medical doctor, or licensed mental health counselor in the State of Florida or any other state in the United States.
• Educational and Coaching Purpose: My services, products, and content are for informational, educational, and general wellness motivation purposes. They are not designed to diagnose, treat, cure, or prevent any physical illness or mental disorder.
• Does not substitute professional treatment: Accompaniment (coaching) does not substitute psychological therapy, clinical counseling, or professional medical advice. If you suffer from severe depression, clinical anxiety, suicidal tendencies, or other mental health conditions, you must seek help from a licensed health provider in your jurisdiction.
• Coach-Client Relationship: Our relationship is one of coaching (training and guidance), designed to establish goals, create results, and manage personal change. No medical-patient relationship exists.
2. ELIGIBILITY AND JURISDICTION
This website and the services offered are directed at users over 18 years of age. By using this site, you declare that you have the legal capacity to enter into a binding contract.
Although the services are online, this agreement is governed by the laws of the State of Florida. If you access the services from outside Florida or outside the United States, you are responsible for complying with the local laws of your jurisdiction.
3. DESCRIPTION OF SERVICES
We offer online accompaniment programs (“Health Coaching”) that may include:
- Individual sessions via video call.
- Wellness plans and goal setting.
- Support via email or messaging (depending on the package).
We reserve the right to deny service to anyone for any reason, especially if we determine that the client’s needs exceed our scope of practice (for example, if clinical psychiatric intervention is required).
4. PAYMENTS, FEES AND BILLING
• Currency: All prices are expressed in US Dollars (USD).
• Payment: Payment must be made in full before the start of the session or program, unless a written payment plan is agreed upon. We use secure payment processors via PayPal.
• Non-Payment: If a payment is rejected or not received, we reserve the right to suspend services immediately.
5. CANCELLATION AND REFUND POLICY
We understand that unforeseen events can arise, but our time is valuable.
• Session Cancellation: At least 24 hours notice is required to cancel or reschedule a session.
o If you cancel with less than 24 hours notice, you will lose the session and no refund will be given.
o If you do not show up for the session (“No Show”) after 15 minutes of waiting, the session will be considered rendered and charged.
• Service Refunds: Due to the intangible nature of coaching services and the time invested, we do not offer refunds once the service has been provided or the package has started.
• Digital Products: There are no refunds for downloadable products (ebooks, guides, pre-recorded courses) once access has been granted.
6. INTELLECTUAL PROPERTY
All content on this website, including texts, graphics, logos, images, audio materials, videos, courses, and worksheets, is the exclusive property of Love Pura Vida and is protected by United States copyright laws.
• Permitted Use: You are granted a limited license to access and use the materials for your personal and non-commercial use.
• Prohibitions: You may not reproduce, distribute, modify, create derivative works, sell, or commercially exploit our content without our express written permission.
7. CONFIDENTIALITY
As a Health Coach, I deeply respect your privacy. I will maintain the confidentiality of information shared during sessions, with the following legal exceptions (Standard of Care):
- If there is an imminent risk of harm to yourself or others.
- If there is suspicion of child or elder abuse.
- If a court order compels me to disclose information.
Note: Please be aware that as this is not a medical-patient relationship under Florida law (HIPAA compliance), the legal protection of confidentiality may differ from that of a licensed psychologist, although we adhere to the highest ethical standards of the coaching industry.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Mari OM shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:
- The use or inability to use our services.
- Any decision made or action taken by you in reliance on the information provided.
- Physical injuries or emotional distress resulting from your interpretation of the coaching.
You agree that you use these services at your own risk and will. You release Love Pura Vida from any demands or claims related to your physical or mental health.
9. DISPUTE RESOLUTION AND GOVERNING LAW
These Terms shall be governed and interpreted in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions.
Any legal dispute or claim arising in connection with these Terms or the services shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida. You waive any objection to jurisdiction or venue in such courts.
10. CHANGES TO THE TERMS
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on the website. It is your responsibility to review this page periodically.
